Information to be provided where personal data are collected from the data subject

  1. 1. Where personal data relating to a data subject are collected from the data subject, the controller shall, at the time when personal data are obtained, provide the data subject with all of the following information:
    1. the identity and the contact details of the controller and, where applicable, of the controller’s representative;
    2. the contact details of the data protection officer, where applicable;
    3. the purposes of the processing for which the personal data are intended as well as the legal basis for the processing;
    4. where the processing is based on point (f) of Article 6(1), the legitimate interests pursued by the controller or by a third party;
    5. the recipients or categories of recipients of the personal data, if any;
    6. where applicable, the fact that the controller intends to transfer personal data to a third country or international organisation and the existence or absence of an adequacy decision by the Commission, or in the case of transfers referred to in Article 46 or 47, or the second subparagraph of Article 49(1), reference to the appropriate or suitable safeguards and the means by which to obtain a copy of them or where they have been made available.
  2. In addition to the information referred to in paragraph 1, the controller shall, at the time when personal data are obtained, provide the data subject with the following further information necessary to ensure fair and transparent processing:
    1. the period for which the personal data will be stored, or if that is not possible, the criteria used to determine that period;
    2. the existence of the right to request from the controller access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing as well as the right to data portability;
    3. where the processing is based on point (a) of Article 6(1) or point (a) of Article 9(2), the existence of the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal;
    4. the right to lodge a complaint with a supervisory authority;
    5. whether the provision of personal data is a statutory or contractual requirement, or a requirement necessary to enter into a contract, as well as whether the data subject is obliged to provide the personal data and of the possible consequences of failure to provide such data;
    6. the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

3. Where the controller intends to further process the personal data for a purpose other than that for which the personal data were collected, the controller shall provide the data subject prior to that further processing with information on that other purpose and with any relevant further information as referred to in paragraph 2.
4. Paragraphs 1, 2 and 3 shall not apply where and insofar as the data subject already has the information.

Consideration-Reasons

60) The principles of fair and transparent processing require that the data subject be informed of the existence of the processing operation and its purposes. The controller should provide the data subject with any further information necessary to ensure fair and transparent processing, taking into account the particular circumstances and framework in which the personal data are processed. In addition, he should inform the data subject that profiling is taking place and what the consequences of this are. If the personal data are collected from the data subject, the data subject should also be informed whether they are obliged to provide the personal data and what the consequences of withholding the data would be. The information in question may be provided in combination with standardized pictorial symbols in order to give a meaningful overview of the intended processing in an easily perceptible, understandable and clearly traceable form. If the icons are presented in electronic form, they should be machine-readable.


(61) The fact that personal data relating to him/her are being processed should be communicated to the data subject at the time of collection or, if the data are not obtained from him or her but from another source, within a reasonable period depending on the specific case . If the personal data may lawfully be disclosed to another recipient, the data subject should be informed when the personal data is first disclosed to that recipient. If the controller intends to process the personal data for a purpose other than that for which the data was collected, he should provide the data subject with information about that other purpose and other necessary information before such further processing. If the data subject could not be informed of where the personal data came from because different sources were used, the information should be kept general.


(62) However, the obligation to provide information is not required if the data subject already has the information, if the storage or disclosure of the personal data is expressly regulated by legal provisions or if informing the data subject proves impossible or involves a disproportionate amount of effort. The latter could be the case in particular for processing for archiving purposes in the public interest, for scientific or historical research purposes or for statistical purposes. The number of data subjects, the age of the data or any appropriate safeguards should be taken into account as indicators.

Artikel 13 Informationspflicht bei Erhebung von personenbezogenen Daten bei der betroffenen Person

  1. (1) Werden personenbezogene Daten bei der betroffenen Person erhoben, so teilt der Verantwortliche der betroffenen Person zum Zeitpunkt der Erhebung dieser Daten Folgendes mit:
    1. den Namen und die Kontaktdaten des Verantwortlichen sowie gegebenenfalls seines Vertreters;
    2. gegebenenfalls die Kontaktdaten des Datenschutzbeauftragten;
    3. die Zwecke, für die die personenbezogenen Daten verarbeitet werden sollen, sowie die Rechtsgrundlage für die Verarbeitung;
    4. wenn die Verarbeitung auf Artikel 6 Absatz 1 Buchstabe f beruht, die berechtigten Interessen, die von dem Verantwortlichen oder einem Dritten verfolgt werden;
    5. gegebenenfalls die Empfänger oder Kategorien von Empfängern der personenbezogenen Daten und
    6. gegebenenfalls die Absicht des Verantwortlichen, die personenbezogenen Daten an ein Drittland oder eine internationale Organisation zu übermitteln, sowie das Vorhandensein oder das Fehlen eines Angemessenheitsbesschlusses der Kommission oder im Falle von Übermittlungen gemäß Artike 46 oder Artikel 47 oder Artikel 49 Absat 1 Unterabsatz 2 einen Verweis auf die geeigneten oder angemessenen Garantien und die Möglichkeit, wie eine Kopie von ihnen zu erhalten ist, oder wo sie verfügbar sind.
  2. (2) Zusätzlich zu den Informationen gemäß Absatz 1 stellt der Verantwortliche der betroffenen Person zum Zeitpunkt der Erhebung dieser Daten folgende weitere Informationen zur Verfügung, die notwendig sind, um eine faire und transparente Verarbeitung zu gewährleisten:
    1. die Dauer, für die die personenbezogenen Daten gespeichert werden oder, falls dies nicht möglich ist, die Kriterien für die Festlegung dieser Dauer;
    2. das Bestehen eines Rechts auf Auskunft seitens des Verantwortlichen über die betreffenden personenbezogenen Daten sowie auf Berichtigung oder Löschung oder auf Einschränkung der Verarbeitung oder eines Widerspruchsrechts gegen die Verarbeitung sowie des Rechts auf Datenübertragbarkeit;
    3. wenn die Verarbeitung auf Artikel 6 Absatz 1 Buchstabe a oder Artike 9 Absatz 2 Buchstabe a beruht, das Bestehen eines Rechts, die Einwilligung jederzeit zu widerrufen, ohne dass die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf erfolgten Verarbeitung berührt wird;
    4. das Bestehen eines Beschwerderechts bei einer Aufsichtsbehörde;
    5. ob die Bereitstellung der personenbezogenen Daten gesetzlich oder vertraglich vorgeschrieben oder für einen Vertragsabschluss erforderlich ist, ob die betroffene Person verpflichtet ist, die personenbezogenen Daten bereitzustellen, und welche mögliche Folgen die Nichtbereitstellung hätte und
    6. das Bestehen einer automatisierten Entscheidungsfindung einschließlich Profiling gemäß Artikel22 Absätze 1 und 4 und — zumindest in diesen Fällen — aussagekräftige Informationen über die involvierte Logik sowie die Tragweite und die angestrebten Auswirkungen einer derartigen Verarbeitung für die betroffene Person.

(3) Beabsichtigt der Verantwortliche, die personenbezogenen Daten für einen anderen Zweck weiterzuverarbeiten als den, für den die personenbezogenen Daten erhoben wurden, so stellt er der betroffenen Person vor dieser Weiterver­arbeitung Informationen über diesen anderen Zweck und alle anderen maßgeblichen Informationen gemäß Absatz 2 zur Verfügung.
(4) Die Absätze 1, 2 und 3 finden keine Anwendung, wenn und soweit die betroffene Person bereits über die Informationen verfügt.
